Maternal death resulting from blood loss from placenta accreta

The plaintiff’s decedent was a 35-year-old mother of three who died in childbirth following a massive hemorrhage. The plaintiff contended that the defendant physicians failed to appreciate the risk and failed to plan for the potential of bleeding.

$35.4 Million Verdict in Mother’s Childbirth Stroke Case Upheld on Appeal


It was agreed that a large volume blood loss is possible in the setting of delivery of a patient with placenta accreta spectrum, thus proper planning and patient optimization is important. This is to assure that all measures have been taken to minimize and prevent blood loss and, should it occur, and treat it quickly.

The plaintiff claimed the doctors should have been more careful when performing the caesarean section delivery and not caused the bleeding when cutting into the uterus. The plaintiff also contended the providers should have activated the massive transfusion protocol sooner.

What the standard of medical care required under the circumstances, and whether any conduct by the providers was in any was causative of the patient’s death, were hotly disputed issues in the case.

The parties pursued discovery aggressively, and were able to resolve the case a week before trial was to begin. The case settled for $2,350,000.
